INTRODUCTION

YMCA 360 STUDIOS, Inc. ("YMCA360" "we," "our," "us," and similar terms) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy ("Policy").

Please read this entire Policy carefully before using or submitting information through the Products (defined below). This Policy will advise you about our practices concerning the use of your personal information, including the reasonable efforts we make to protect your personal information, and about the choices you have concerning our use of such information. This Policy applies to our Products except where otherwise noted.

By downloading, installing, registering with, accessing, or using the YMCA360 on-demand video platform and related applications (collectively, "App"), our website ("Website"), or other YMCA360 programming, goods, or services (our App, Website, and all YMCA360 programming, goods, and services are collectively referred to herein as "Products"), you agree to this Policy. By using or submitting information through the Products, you are acknowledging the collection, transfer, manipulation, processing, storage, disclosure, and other uses of your personal information as described in this Policy. If you do not agree with our policies and practices, do not download, install, register with, access, or use our Products.

This Policy may change from time-to-time, as further described in the section about Updates to Our Privacy Policy below.

Your use of the Products is also subject to our Terms of Use, found at https://ymca360.org/terms.

SCOPE OF PRIVACY POLICY

This Policy describes:

  • The types of information we may collect or that you may provide when you download, install, register with, access, or use any Products, including the YMCA360 App and related software or technology.
  • Our practices for collecting, using, maintaining, storing, protecting, and disclosing that information.

This Policy applies only to information we collect (a) through our Products; (b) in email, text, and other electronic communications sent through or in connection with your use of our Products; (c) our affiliates; and (d) from third parties we partner with to provide services to you through our Products.

This Policy DOES NOT apply to information that you provide directly to, or is collected by, any third party (see section on Third Parties below).

INFORMATION WE COLLECT AND HOW WE COLLECT IT

Depending on how you interact with YMCA360 and our Products, we may collect your personal information. The sources from which we collect this personal information fall into three categories: (i) information you provide; (ii) information we collect automatically; and (iii) information we collect from other sources. See below for more information on the types of personal information in each category.

Information You Provide

When you interact with YMCA360, you may volunteer personal information, or you may be asked to provide personal information in order for us to provide the Products and related services as described. Examples of ways in which you interact with us include: downloading our App, accessing our Products, completing and/or using one of our registration forms, reviewing our content, contacting us with inquiries, responding to one of our surveys, or uploading your own content to our App.

Standard Identifying Information. Name, mailing address (including zip code), billing address (including zip code), email, date of birth, and phone number. These are collected when you register for our Products, subscribe to YMCA360 marketing, communicate with us, or sign-up for fitness challenges and YMCA events.

Membership Information. Membership status, My Y check-in details, Y association details if you are a member of an associated YMCA using our Products, classes you register for, video content you view, registration details related to YMCA events, classes, camps, and other activities or programs you participate in, and registration for surveys, forums, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, or other services or activities offered on our Website or through our App. We may also collect your search queries or viewing history of the content provided through our App.

Purchase Transaction Information. When you make a payment or donation, we collect information to process the financial transaction and may use that information to contact you in the future about YMCA360 and its Products. We also collect details of transactions that you carry out through the App and Website and of the fulfillment of your orders, including delivery information (e.g., billing, shipping, and delivery address) that you provide when you purchase or sign-up for our Products. Please note, we do not store or capture any credit card information. Your payment information is transmitted to us, using a secure Internet method that helps maintain the privacy of this information. When your personal data is stored by us, we use computer systems with limited access housed in facilities using physical security measures. Personal information is stored and transmitted in encrypted form, including when we utilize third-party storage.

User Profile Information. Information that you provide in connection with your YMCA360 profile on the App, including, but not limited to, your photo, name, health goals, birthday, height, weight, gender, favorite activities, and favorite instructors.

Geolocation Data. We will only have your location when you use the barcode feature on the App. This allows us to determine your geographical area for points and reward offerings in connection with our Products you sign up for. We also collect your zip code during the login process to provide you a list of nearby YMCA branches to select from for authentication. If you choose to share your location, depending on how you use the Products and your device settings, type and connectivity, we may collect location-based information including your IP address, GPS location, zip code, and region.

Your Name, Image, or Likeness. Your name, profile name, social handle, or visual image or likeness (e.g., via photographs or video) if you create a profile on our App or participate in classes used for on demand videos or streamed live through our App.

Workout Characteristics. Information you provide in order to track your workouts and performance while using our Products, such as height, weight, age, and gender. We may also collect additional data points like other fitness and health metrics and daily physical activity.

User Generated Content. Any content or material you publish or post such as hashtags, photos, written materials, or videos on our App. For more information, please see our Terms of Use at https://ymca360.org/terms.

Connected Devices, Wearables, and Accounts. We enable you to connect your YMCA360 account with third parties (i.e. devices, apps, APIs, or websites that integrate with the App). Where you choose to connect another company's device, wearable, or account to your YMCA360 account, or engage in our Products that feature a partnership with a third party, we may, with your consent, collect information from your use of the connected devices, wearables, or accounts to facilitate interaction with our Products. Wearables or activity trackers, such as an Apple watch, Garmin, Fitbit, or Google watch are each an example of a connected device, and music streaming or Apple TV or Amazon Fire TV Stick are each an example of a connected account. Through your connected devices and accounts we will also process fitness data, health metrics, and daily physical activity to improve your experience and fitness results when using our Products. Information collected by these third parties is subject to their terms and policies and may not provide you with the same privacy controls that are available on YMCA360. We encourage you to review the applicable privacy policies and terms of use of these third parties connected to YMCA360 Products.

Feedback and Support Communications. Any details of your communications/interactions with us, including when you call, email, live chat, video call, or text with our support teams or communicate with us via social media channels or community forums. We may record support calls for training and monitoring purposes and to help resolve issues. We will tell you before recording and, where required by applicable laws, obtain your consent for the collection of these recordings. Our live chat service provider records information submitted in the chat bot, as well as any dialogue with member support. We collect, retain, and use communication information based upon our business need to receive and act upon your feedback or issues and for training purposes.

Surveys and Review Information. Any information you voluntarily provide to us or our service providers (or otherwise publish) in connection with a survey you complete or review / testimonial you provide about YMCA360 or our Products. We may collect this information to understand your opinions, better market our Products, and to collect relevant information about our business.

Promotions, Sweepstakes, and Competition Information. Any information that you provide to us in connection with any promotions, sweepstakes, challenges, and/or competitions we run or host, including participant details and progress, communications with participants during the challenges or competitions, feedback or reviews about promotions, sweepstakes, challenges, or competitions offered by us.

Sensitive Personal Information. We will only process sensitive personal information where it is necessary and where you give consent for the purposes of (i) providing our App or those Products you register for or request; and (ii) carrying out our legal obligations or exercising specific rights as permitted by law. The definition of "sensitive personal information "depends on jurisdiction and where you reside, but health data, location data, or information about your children are examples of what may be considered sensitive in some locations. Please also review the section on Your Privacy Rights and Preferences below.

We ask that you not disclose sensitive personal information to us through or in connection with our Products unless we have explicitly requested such disclosure from you.

Other Information. Any other information that you may provide to us in connection with your use of our Products, visits to YMCA locations, or other contact that you have with our YMCA team.

Information that We Collect Automatically

Information generated through use of the Products . This includes activities such as classes registered for and participated in, search queries, details of workout performances such as leaderboard rank, total workout output, workout speed, distance, calories burned and accuracy of metrics/pace compliance, class level and difficulty, and in-studio attendance history.

Fitness Data . Information relating to your fitness performance and/or workouts, including things like calories burned, distance, and length of workout. For more information see the section related to Fitness Data below. We do not collect medical information, however, some privacy-related legislation may classify some of our workouts, wellness portals, or accessibility offerings as health-related information. Some examples: pregnancy-related workouts, health metrics, or workouts related to your mood.

Inferences . We may collect data and make inferences based on that data, but the inferences are not used to infer specific characteristics about you other than what workouts, classes, or challenges you may enjoy. For more information, see the section on Fitness Data below.

Information from Your Device . Information from and about the device you use when you use our Products, including IP address, identifiers, type, mobile carrier, telephone number, browser type and language, operating system, and location (if enabled or you use the barcode feature in your App, see the section on Geolocation Data above).

Usage Data . We may also collect information about how your device interacts with our Products, such as the content you access, pages and sites visited before and after you reach the services and content offered through our App, the date and time of your use, the amount of time spent on the App, and other actions taken through use of the Products such as preferences. We use data analytics with this Usage Data to better understand your use of the Products in order to improve the App and services offered. For more information, see the section on Cookies, Analytics, and Similar Tracking Technology below.

Internet or Other Network Activity . Information including browsing or search history, including interactions with our Website, App, or marketing and advertising. For more information, see the section on Cookies, Analytics, and Similar Tracking Technology below.

Stored Information and Files . The App may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.

Location Information . If you choose to share your location, depending on how you use the Products and your device settings, type and connectivity, we may collect location-based information including your IP address, GPS location, zip code and region. Some of this information may be collected using cookies and similar technologies as described below.

Information We Collect From Other Sources

Other Applications. If you access our Products through a third-party application, such as native mobile apps like IOS and Android; TVOS platforms like Apple TV, Android, Roku, and Amazon Fire TV Stick; Apple App Store or Google Play App Store (together with any similar applications, "App Stores"); or social networking sites ("SNS") such as Instagram, Twitter, or Facebook, we may collect information about you from that third-party application that you have made public via your privacy settings. This may include: your name, your SNS user ID, your App Store user name, location, sex, birth date, email, profile picture, and your contacts on the SNS.

Security and Safety. We may collect certain information in order to protect and verify your information and our Products. This may include device IP, location, and other identifiers with a third-party application to ensure your safety and the security of your account.

Third Party Partners. We may partner with third parties, such as employers or other Y associations that offer YMCA360 Products to their employees or members, respectively. In such cases, those third parties may provide us with your name, email address, physical address, telephone number, or other membership information (like barcode or family members) so that we can invite you to participate and/or determine your eligibility for particular benefits, such as rewards or free services.

Other Sources. We may receive information about you from other sources to supplement information provided by you. The supplemental information allows us to enhance our ability to provide you with information about our business and services and improve our Products functionality and features. Depending on the source, we may receive information that allows us to provide you with any marketing communications that you have provided your consent to receive. Please see the section on Your Privacy Rights and Preferences below for how to unsubscribe to marketing communications.

Other sources may include:

  • Marketing such as where we are conducting a joint marketing campaign with a selected partner and you have provided consent for us to receive your information.
  • Publicly available sources.
  • Partners we work with may, with your consent, collect information from your use of other connected devices or wearables, such as those made by other companies like Apple, Fitbit, or Garmin, to interact with our Products, such as activity trackers.

WHY WE USE YOUR INFORMATION

We use your information for the following purposes:

  • Provide you with the Products.
  • To communicate with you and provide support.
  • To send you marketing materials and/or promotions.
  • For analytics, research, and Product improvement purposes.
  • For quality assurance and training purposes.
  • For personalization and analytics.
  • For personalization and advertisement.
  • To ensure the security and integrity of our Products.
  • To comply with any applicable law and/or regulations.
  • To comply with and perform under our contractual obligations with you, our partner Y associations, or our service providers in connection with our Products.
  • For safeguarding and defending our vital interests and exercising any rights, asserting any claims, and any other lawful business purpose

Provide you with the Products.YMCA360 uses data to operate, improve, maintain, and personalize our Products. We use data to:

  • Verify your identity, set up, and maintain your account;
  • Process transactions and fulfill product orders;
  • Provide access to on-demand videos, live stream classes, fulfill scheduling requests, class bookings and participation, and workout tracking, performance, and statistics;
  • Communicate and compare your workout among other participants in challenges or competitions you sign up for; and
  • Maintain our services and operations.

Communication and Support. YMCA360 uses data to communicate with you and provide support when you require it such as for:

  • Administrative matters (such as account management, updates to terms, or system maintenance);
  • To provide you with information about our Products (such as delivery and logistics, servicing, and technical support); and
  • To respond to any questions, comments, or requests you have about our Products.

Marketing and Promotions. YMCA360 uses data to market its Products, which may include:

  • Contacting you by phone, email, postal mail, push notifications, in-App messages or SMS with information about news, offers, products, promotions, events, contests, challenges, and/or services that might be of interest to you, as permitted by applicable law. This may include various usage data to send marketing communications that are personalized. Please see the section on Your Privacy Rights and Preferences below for how to unsubscribe from our marketing communications.

Analytics, Research, and Product Development. YMCA360 is committed to bringing the YMCA experience directly to your home or remote location. YMCA360 is continuously trying to improve your experience by using data for these business purposes, including:

  • Monitoring and measuring your use of our Products and conducting research and surveys, to understand how they are being used and how they can be improved;
  • Monitoring and measuring data from your connected devices and wearables used with our Products to make your experience better and improve our Products and connectivity.
  • In some cases, research data may be deidentified, compiled, and analyzed on an aggregate basis, we may share this aggregate data with our affiliates, agents, service providers, and other third parties with whom we do business. Examples include, but is not limited to, usage, performance, product, and music. This aggregate information does not identify you personally.

Quality Assurance and Training Purposes. YMCA360 aims to provide quality Products designed to bring the YMCA experience directly to you through your connected device and/or in partnership with our Y associations. We use data to further that value by:

  • Monitoring communications and interactions with you to ensure the quality of our support services, appropriate training of our people, and to resolve your complaints. We will provide notice and consent options for monitoring of communications as required by applicable law.

Personalization and Analytics. We use data to tailor your experience to your specific interests and goals such as:

  • To provide workout recommendations to you based on our inferences about your preferences and practices;
  • To improve our Products and related services and offerings;
  • To understand how you interact with our Website, App, other Products, advertisements, and communications with you;
  • To determine which of our Products and features are the most popular;
  • To improve our marketing campaigns;
  • To personalize your experience and continue to improve that experience, including speeding up your searches and recognizing you when you use our App;
  • To understand how you use our Products;
  • To better understand the needs of our members and partner Y associations; and
  • To provide personalized recommendations about our Products.

You may opt out of some personalized services by emailing us at support@ymca360.org. See also the section on our Privacy Rights and Preferences section below for more details on how you can control advertising and personalization.

Personalization and Advertising. YMCA360 uses data for personalization and advertising that may include:

  • Providing you with a personalized and tailored service offered by YMCA360;
  • To serve you with relevant advertising and content on our Products; and
  • Understanding and assessing the effectiveness of our ads displayed.

Security and Integrity of Our Products. Providing a safe and secure environment is key to providing a responsible platform and we do this by using data to:

  • Detect and combat any abuse or any harmful activity, fraud, spam, and illegal activity affecting our Products such as using personal identifiers, user profile, data usage, and other types of data to detect fraud, authentication, or other harmful activity;
  • Monitor content on the App;
  • Prevention & detection of crime; and
  • Protect the health and safety of members using our Products.

Compliance. We use data to investigate disputes or claims related to our Products. In certain circumstances, we may be obligated to use your information to respond to legal, government, or regulatory requests and comply with our obligations under applicable laws and regulations. We may use the IP address associated with your account or barcode to the Products to determine your general location in order to comply with governing privacy regulations and serve you necessary notifications and/or consent mechanisms.

Contractual Obligations. We use data in the performance of our contractual obligations with you or the Y associations and employers we partner with to offer the YMCA360 Products and experience to the Y association's own members or the employer's employees. We may also use data in the performance of our contractual obligations with service providers we contract with to provide you certain services in connection with your use of our Products.

Protecting Vital Interests, Rights, and Lawful Business Purposes. From time-to-time, we may use data for safeguarding and defending our vital interests, exercising any rights we may have under law or contract, asserting any claims or defenses, and for any other lawful business purpose. This includes any incidental business purpose related to or in connection with any of the above, or for any other purpose disclosed to you at the point at which we collect your personal information.

WHO WE SHARE YOUR PERSONAL INFORMATION WITH

We do not rent or sell your personal information. We do not engage in targeted advertising that focuses on your interests or preferences gained from tracking your activity across nonaffiliated websites or applications. However, we may share your personal information to the following categories of recipients:

Service Providers. YMCA360 may share personal information with trusted service providers, such as payment processors, technology partners, analytics providers, cloud storage providers, or other providers that need access to your information to provide operational or other support services while you are a YMCA360 member or program participant. We may disclose aggregated, anonymous information to our service providers for analytics purposes.

Business Partners. YMCA360 may share personal information with our business partners who otherwise process personal information for purposes described in this Policy, such as advertising and marketing partners, research partners, and consultants, or who are otherwise disclosed to you when we collect your personal information. In certain circumstances, we may also share information with our affiliates and select similar nonprofit organizations that may offer activities of interest to you.

Third Party Applications. As part of the functionality of our App, we enable you to connect your YMCA360 account with third party applications such as Fitbit, Apple, Garmin, Google, Roku, Amazon Fire TV Stick, and other similar applications. If you choose to connect your YMCA360 account, we may share certain personal information with the paired application depending on what information you choose to share with such third-party apps or have otherwise been notified will be shared during the pairing process. The information may include information generated through your use of the App (example, workout information) and other contact and profile information. The processing of your personal information by such third-party applications shall be governed by the privacy policies of those third parties.

Other YMCA360 Users. – Your user profile is not visible to the public, except your screen name may be visible when you participate in a group chat or on a challenge leaderboard.

Government Agencies, Regulators, Law Enforcement, and Courts. We may share your personal information with competent law enforcement bodies, regulators, our insurers, external legal advisors, government agencies, courts, or other third parties where we believe disclosure is necessary to: (i) comply with applicable law; (ii) exercise, establish or defend our legal rights; (iii) protect your rights or vital interests or those of any other person; or (iv) detect, prevent, or otherwise address security, fraud, or technical issues.

Potential Buyers (and their agents and advisors). We may share your personal information with actual or potential buyers (and their agents and advisors) in connection with any actual or proposed purchase, merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of YMCA360 assets or transition of service to another provider. In such a case, we will inform the buyer or transferee that it must use your personal information only for the purposes disclosed in this Policy.

Deidentified Data. We may disclose deidentified information about our users and information that does not identify any individual or device, without restriction.

COOKIES, ANALYTICS, AND SIMILAR TRACKING TECHNOLOGIES

We use cookies and similar tracking technologies such as pixel tags/web beacons and social media widgets (collectively "Cookies") to collect and use personal information about you, including for analytics purposes and to serve you interest-based advertising. Below is an overview of Cookie technology:

  • Cookie: A cookie is an element of data that a website can send to your browser, which may then store it on your system to help enhance your experience in using our sites and to provide us with technical information about your usage.
  • IP Address Tracking: An IP address is a number that is assigned to your computer or device when you are on the Internet. When you request pages from our sites, our servers log your IP address.
  • Web Beacons: A web beacon, or "clear gif,"is a small graphic image on a webpage or web-based document that a website can use to determine information about a user. Non-personally identifiable information might include the browser you use, the type of computer you use, technical information about your means of connection to our Website (such as the operating systems and the Internet service providers utilized), and other similar information. Our systems may also automatically gather information about the areas you visit and search terms you utilize on our Website and about the links you may select from within the sites to other areas of the World Wide Web or elsewhere online.
  • Do Not Track Signals: Although an industry-standard do-not-track ("DNT") protocol has not yet been established, YMCA360's information collection and disclosure practices and the choices it offers to consumers will continue to operate as described in this Policy.

We may also use device identifiers, web storage, third-party-provided analytics services, such as session replay services, and other similar technologies and services, to collect information about your interactions with our content and Products. Session replay services consist of an analytics application that allows us to capture and analyze your interaction with our Products to better identify and repair any technical errors and optimize our Products. Such technologies and third- party-provided services may observe or record your activities when using our Products, including certain movements, scrolling, visit duration, clicks, and other interactions. Certain analytics may be removed via our privacy Cookie controls; however, such removal may impair or cut off your use of our Products.

FITNESS DATA

"Fitness Data" means any information relating to your fitness performance and/or workouts, including things like, calories burned, distance, and length of workout. We do not use or process your Fitness Data for identification purposes.

Why we process your information?

  • Analyze your Performance: As part of our core offering, we use Fitness Data to compare your past and current performance and to provide you with analytics about your progress over time.
  • Provide Workout Recommendations: We may recommend workouts to you based on our inferences about your preferences and practices, including for example recommendations about certain classes or content that are based on your previous exercises. Recommendations include information derived from Fitness Data we collect from you.

YMCA360 will not disclose, redisclose, or otherwise disseminate Fitness Data unless:

  • Authorized by you or your authorized representative; for example, if you pair a third-party fitness tracker or connect a wearable to our App, you are authorizing the disclosure of your Fitness Data to the third-party device;
  • In aggregated and de-identified formats to assist us and our service providers, vendors, or partners in providing services to you;
  • Required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction; or
  • As required under applicable law, necessary for the establishment, exercise, or defense of legal claims, and as may be required by governing courts acting within their judicial capacity.

HEALTH CONNECT DATA

Our App is compatible with technologies like Google Fit and Google Health Connect for Android users and Apple Health for Apple users and devices. These types of health connected technologies allow your health, wellness, and fitness apps or devices to communicate with each other to develop tailored health and wellness plans for you and provide customized recommendations to improve your health and well-being.

When you consent to share your health, wellness, and Fitness Data with us using the applicable health connect feature, we will collect such data from your other connected applications. However, we will only use such data to provide or improve our App and features that are visible and prominent in your user interface.

We will not share or transfer your health, wellness, or Fitness Data collected through Google Health Connect or Apple Health with others except in the following circumstances:

  • To provide or improve our App or features that are clear from the requesting application's user interface and only with your consent;
  • If necessary for security purposes (for example, investigating abuse);
  • To comply with applicable laws and regulations; or
  • As part of a merger or acquisition or sale of assets of YMCA360 after obtaining your prior explicit consent.

Our use and transfer of information received from Google APIs to any other Google app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

PRIVACY OF CHILDREN

We are mindful that young people need special safeguards and privacy protection. We realize that they may not understand or be able to meaningfully consent to the provisions of our Policy or be able to make thoughtful decisions about the choices that are made available to our adult users. We strongly urge all parents or legal guardians to participate in their children's exploration of the Internet and any online services and to teach their children about protecting their personal information while online.

Information We Collect

To provide the App and other Products we offer, we sometimes need to collect certain information about children.

YMCA360 may collect and store persistent identifiers such as Cookies or IP addresses from children without parental consent for the purpose of supporting the internal operation of the App.

We may collect and store other personal information about children under the age of 13 if this information is submitted by a child with parental consent or by the parent or guardian of the child, including:

  • First and/or last name
  • Mailing address
  • Date of birth
  • Gender
  • Grade level
  • Email address
  • Telephone number
  • Parent's or guardian's name
  • Parent's or guardian's email address
  • Fitness Data
  • Health data when the child uses a connected device or wearable

If we learn of, or identify a child, under the age of 13 with an existing account or profile on our App, we will request an email address for the child's parent or legal guardian and use commercially reasonable efforts to obtain consent from such parent or legal guardian.

Parental Access

A parent or legal guardian who has already given YMCA360 permission to collect and use the parent's or legal guardian's child personal information can, at any time:

  • Review, correct, or delete the child's personal information.
  • Discontinue further collection or use of the child's personal information.

YOUR PRIVACY RIGHTS AND PREFERENCES

Your Privacy Rights

YMCA360 respects your privacy rights and choices. Where possible, we give you control over the personal data we collect about you, to ensure it is accurate and reflects your preferences. Users of our Products have the following privacy rights:

  1. Opt Out: You have the right to opt out of the sale of their data, targeted advertising, and profiling.
  2. Access: You have the right to verify whether or not your data is being processed and then gain access to the data.
  3. Correction: You have the right to correct any inaccurate information in the data we process.
  4. Deletion: You have the right to request that we delete your data.
  5. Data Portability: You have the right to obtain an electronic copy of your data and transfer it to a third party.
  6. Appeal: You have the right to appeal our actions regarding your requests.

Please note, however, that these rights do not always apply and there are certain exceptions to them.

Consent. If we have collected and process your personal information with your consent (including any sensitive or special category data), then you can withdraw your consent at any time by using settings on the YMCA360 App, via settings on your connected device, or by contacting us using the details provided under How To Contact Us below. Please note, such withdrawal will not affect the lawfulness of the processing prior to your withdrawal.

Direct Marketing. We may send marketing communications for purposes disclosed to you in this Policy and, where required by applicable law, with your consent. You can unsubscribe from direct marketing at any time by following the instructions below or by contacting us using the details provided under the How To Contact Us. We will process your request within a reasonable time after receipt, in accordance with applicable laws. Unsubscribe options are provided in electronic marketing communications as required by applicable law.

Email. You can unsubscribe from email communications at any time. To stop receiving our promotional emails, follow the unsubscribe instructions in the email messages you receive from us. For other options, review the How To Contact Us section below. We will process your request as soon as practicable after receipt, in accordance with applicable laws. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding YMCA360 and our Products and, to the extent permitted by law, you will not be able to opt-out of those communications (e.g., communications regarding updates to our Terms of Use or this Privacy Policy).

SMS Messaging and Marketing Related Texts. If you opt in to receiving YMCA360 text messages, you will receive text messages from YMCA360 marketing, including recurring automated promotional and personalized marketing text messages from YMCA360 at the cell number used when signing up. Consent to text message is not a condition of any purchase or use of our Products. To opt-out of receiving YMCA360 text messages, text STOP to the number from which you received the message (75865 in the US). We will send you one final message to confirm that you have been unsubscribed, and will process your request within a reasonable time after receipt, in accordance with applicable laws. If you experience any issues with text messages from YMCA360, text HELP to the relevant number referenced above or email us at support@ymca360.org. Carriers are not liable for delayed or undelivered messages. Message frequency varies. Message and data rates may apply.

We maintain "do-not-call" and "do-not-mail" lists as mandated by law. We process requests to be placed on do-not-mail, do-not-phone and do-not-contact lists within the timescales required by law.

Push Notifications. If you opt-in on your connected device, YMCA360 may occasionally send you push notifications through our App with updates, achievements, and other notices that may be of interest to you. You may at any time opt-out from receiving these types of communications by changing the settings on your connected device.

Updating your Personal Information

You can update your personal information by using the features provided in the App or contacting us at support@ymca360.org. However, do NOT send Social Security numbers or other sensitive information to us via unencrypted email.

DATA RETENTION

YMCA360 retains personal information we receive as described in this Policy for the purpose(s) for which it was collected, provide our Products, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. For example, we keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account.

When we no longer need your personal information for a business purpose, or are no longer required to retain the personal information as described above, we will destroy, erase, or de- identify it. However, legal requirements may require us to retain some or all of the personal information we hold for a longer period of time even after our business purpose or need expires.
